FEDERAL COORDINATION OF PUBLIC POLICIES: the national systems of regulated policies

Resumo: | The 1988 Constitution brought numerousinnovations on public policies. One of them wasthe definition of a range of competences sharedbetween the three spheres of government. Ofthese competences, some depend on the voluntaryadherence of the states. This is the case of thepolicies here called regulated. The article analyzeswhy states adhere to these systems, what are theincentives for adherence and cooperation, and whatare the federal government’s induction instrumentsfor policy enforcement. The article presentstheoretical and empirical contributions. The firstis based on theories that emphasize the role ofrules, incentives and design for the implementationof policies in federal countries. The empirical isthe collection of data on the functioning of thesesystems – public security, culture, tourism andhousing, in the period 1996-2014 through a database of more than 30,000 occurences. The articleconcludes that despite the regulatory activismof the federal government, the adherence of thestates is conditioned by their capacities and thatthe systems’ obstacles have not been the object of asystematic evaluation. |

L’uned’entre elles était la définition d’un éventail decompétences partagées entre les trois sphères degouvernement. Parmi ces compétences, certainesdépendent de l’adhésion volontaire des états. C’estle cas des polices dites ici standardisées. Le articleanalyse pourquoi les états adhèrent à ces systèmes,quelles sont les incitations à la coopération, et quelssont les instruments d’induction du gouvernementfédéral pour l’application des politiques. Learticle présente des contributions théoriques etempiriques. La théorie est basée sur des théoriesqui mettent l’accent sur le rôle des règles et desincitations pour la mise en oeuvre des politiquesdans les pays fédéraux. L’empirique est la collectede données sur le fonctionnement de ces systèmes– sécurité publique, culture, tourisme et logement,dans la période 1996-2014. Le article conclut quemalgré l’activisme réglementaire du gouvernementfédéral, l’adhésion des états est conditionnée parleurs capacités et que les obstacles du système n’ontpas fait l’objet d’une évaluation systématique.A Constituição de 1988 trouxe inúmeras inovações sobre políticas públicas. Uma delas foi a definição de um leque de competências compartilhadas entre as três esferas de governo. Dessas competências, algumas dependem da adesão voluntária dos estados. Este é o caso dos sistemas de políticas aqui denominados de normatizados. O artigo analisa por que os estados aderem a esses sistemas, quais os incentivos para a cooperação e quais os instrumentos de indução do governo federal para o enforcement das políticas. O artigo apresenta contribuições teóricas e empíricas. A teórica é o apoio nas teorias que enfatizam o papel das regras, dos incentivos e do desenho da política para a implementação de políticas em países federais. A empírica é a montagem de um banco de dados com cerca de 30 mil ocorrências, que correspondem ao número de convênios firmados entre o governo federal e os estados e que mostram o funcionamento desses sistemas – segurança pública, cultura, turismo e habitação, no período 1996-2014.
