Queer theory and legal order:: reflections on a queer theory of law

Resumo: This work aims to understand what a “queer theory of law” could be, that is, how the criticisms of the queertheory could contribute to the legal sciences as to revolutionize what the law understands by sex, gender, and sexuality. As a normative framework, law has always designed sex, gender, and sexuality; however, the legal field constructs these dimensions from the perspective of nature, strengthening heteronormativity, fixed identities, sexual and gender binarisms,as well as the sex-gender-sexuality logic that queer theory aspires to dismantle. Thus, through an exploratory research and a bibliographic review of queer studies, this study understands that a queer theory of law must undertake dismantling and strangeness to the norms of the legal field, criticizing the normatization engendered by them concerning the categories ofsex, gender, and sexuality. Consequently, a queer theory of law imposes the inclusion of all those who are on the verge of citizenship and heteronormativity within the legal universe, contemplating all subjects regardless of sex, gender, or sexuality.

El Derecho como marco normativo siempre ha tomado en consideración el sexo, el género y la sexualidad; sin embargo, el campo legal construye estas dimensiones desde la perspectiva de la naturaleza, retroalimentando y fortaleciendo la heteronormatividad, las identidades fijas, los binarismos sexuales y de género, así como la lógica de sexo-género-sexualidad a la cual la teoría queer aspira a desmantelar. Por lo tanto, es desde una investigación exploratoria y de revisión bibliográfica de estudios queer que este estudio comprende que una teoría queer del derecho debe emprender el desmantelamiento y el alejamiento de las normas del campo legal, a fin de criticar la normalización engendrada por dichas normas con respecto a las categorías de sexo, género y sexualidad. En consecuencia, una teoría queer del derecho impone al universo legal a todos aquellos que están al borde de la ciudadanía y la heteronormatividad, contemplando todos los sujetos sin prestar atención a su sexo, género o sexualidad.O escopo deste trabalho é compreender o que poderia ser uma “teoria queer do direito”, vale dizer, como as críticas empreendidas pela teoria queer poderiam se imiscuir nas ciências jurídicas de maneira a revolucionar o que o direito compreende por sexo, gênero e sexualidade. O direito, como estrutura normativa, sempre arquitetou sexo, gênero e sexualidade; todavia, o campo jurídico arquiteta essas dimensões sob o prisma da natureza, retroalimentando e robustecendo a heteronormatividade, as identidades fixas, os binarismos sexuais e de gênero, assim como a lógica sexo-gênero-sexualidade que a teoria queer aspira desmantelar. Assim, por intermédio da pesquisa exploratória e da revisão bibliográfica em estudos queer, este estudo compreende que uma teoria queer do direito deve empreender desmantelamentos e estranhamentos às normas do campo jurídico, de maneira a criticar a normatização engendrada por tais normas jurídicas concernente às categorias de sexo, gênero e sexualidade.
