The right to Integral Reparation in the Paraopeba River basin: a critique of the racist and cis-heteropatriarchal mining model

Resumo: The present article proposes a critical debate on access to Comprehensive Reparation in cases of desaster-crimes of major proportions. Four authors use situated epistemology to analyze the reparation model in the context of the dam rupture crime by Vale S.A. in Brumadinho, Minas Gerais, which occurred on January 25, 2019. We carried out the job through the intersectional lenses of black feminism, environmental racism, territory and territoriality and decolonial and community feminisms to understand how the matrix of intersectional domination interferes with the participation in the reparation process and access to rights of the most precarious layers of the affected population. We conclude that the racist and cis-heteropatriarchal model of mining/development that generates damages and losses linked to the transversality of historical oppressions, considering the intersectionality of identities, social and bodily markers, interferes in the reparation process. For this reason, Comprehensive Reparation should be more closely linked to understanding the specificities of the different social sectors affected in accessing their rights.

Cuatro autoras utilizan el pensamiento situado para analizar el modelo de reparación por el crimen de la ruptura de la represa de Vale S.A. en Brumadinho, Minas Gerais, ocurrido el 25 de enero de 2019. Realizan la tarea a través de los puntos interseccionales del feminismo negro, el racismo ambiental, territorio y territorialidad yde feminismos decoloniales y comunitarios para comprender cómo la matriz de dominación interseccional interfiere en la participación y acceso a derechos de las clases más precarias de las poblaciones afectadas. Concluyen que el modelo racista y cis-heteropatriarcal de minería/desarrollo que genera daños y perjuicios vinculados a la transversalidad de lasopresiones históricas, considerando la interseccionalidad de identidades, marcadores sociales y corporales, interfiere en el processo de la reparación. Por lo tanto, la Reparación Integral tendría que estar más vinculada a la comprensión de las especificidades de los distintos segmentos sociales afectados en el acceso a sus derechos.O presente artigo propõe um debate crítico sobre o acesso à Reparação Integral em casos de crimes-desastres de grandes proporções. Quatro autoras se valem do pensamento situado para analisar o modelo posto de reparação ao crime do rompimento da barragem da Vale S.A. em Brumadinho, Minas Gerais, ocorrido em 25 de janeiro de 2019. Realizamos a tarefa através das lentes interseccionais do feminismo negro, do racismo ambiental, de território e territorialidade e dos feminismos decolonial e comunitário para entender de que maneira a matriz de dominação interseccional ingere na participação e acesso a direitos das camadas mais precarizadas das populações atingidas. Concluem que o modelo racista e cis-heteropatriarcal de mineração/desenvolvimento que gera danos e perdas vinculadas à transversalidade das opressões históricas, considerando a interseccionalidade das identidades, dos marcadores sociais e corporais, interfere no processo de reparação.
