São Bernardo do Campo, 2022O trabalho possui divulgação autorizada (fonte: Sucupira)O objetivo da pesquisa é compreender em que medida o direito afeta as dinâmicas de ocupações ameaçadas de remoção constituídas por migrantes e não migrantes, analisando a forma que o direito opera socialmente, constituindo circuitos tidos como informais nestas moradias, como funciona e se organiza tais dinâmicas a partir da perspectiva constante da remoção e se possuem a capacidade de afetar os desdobramentos da ação judicial. As análises são feitas a partir de duas ocupações da cidade de São Paulo, Vila das Belezas, no bairro Vila Andrade, e 21 de abril, no bairro Brás. Foram acompanhadas as trajetórias dos moradores, as dinâmicas que se formam nas ocupações a partir da ameaça de remoção em meio à pandemia de Covid-19, os agentes e instituições que passam a orbitar a localidade, questionando o papel do direito e da ação judicial na constituição dessas dinâmicas e circuitos. O material da pesquisa é composto pelas ações judiciais, trajetórias da moradia de moradores das ocupações no Brasil, entrevistas semiestruturadas e pesquisa de campo realizada a partir da pesquisaação.The aim of this study is to understand to what extent the law affects the dynamics of squat buildings constitute by migrants and non-migrants, analyzing the way that the law operates, constituting circuits considered informal by the State, how such dynamics work and are organized with the perspective of eviction and whether they have the ability to affect the outcome of the lawsuit. The analyzes are made from two squat buildings in the city of São Paulo, Vila das Belezas, in the Vila Andrade neighborhood, and 21 de Abril, in the Brás neighborhood. The trajectories of the residents, the dynamics with the perspective of eviction during the Covid-19 pandemic and the agents and institutions that start to orbit the locality were followed, questioning the role of law and legal action in constitution of these dynamics.
