This work aims to study the Environmental Law, focused within the areas of accountability possible to those whose action or inaction, causing damage to the environment, depriving people of a constitutionally guaranteed right of access to a healthy environment and balanced. Once established the responsibilities, seeks to legally protect the environmental damage and its repair. Initially are presented to the reader some concepts necessary for better understanding of what is the environment, damage and liability. Once granted the basic concepts necessary, pass the examination of the central theme of this work, which is the analysis of environmental liability. The study seeks to clarify concepts such as the environment and environmental damage, which forms most appropriate for the treatment being accorded to full effect the repair of damage that category and what the structures, institutions and mechanisms that are worth the legal system to the solution of problems related to reintegration of the environment damaged, highlighting the peculiarities and theoretical difficulties and practices of each of these legal institutions. When talking about environmental damage, it is necessary to examine its features and highlight the importance of its prevention and repair of its effects, including the first with greater importance as the most important responsibility. Valid out that the repair, where possible, will be made in nature. We set on the three types of environmental liability established constitutionally those who attack or endangers the right to healthy environment, highlighting its main points. After all, it is for everyone, including the Public Power, preservation and protection of the environment, which has the legal right to diffuse.
