This study analyzes the need and the compatibility of the typification of the misdemeanors offenses with the guiding principles of Minimum Criminal Law. The relevance of the theme is due to the need to seek to increase the efficiency of criminal prosecution, as well as making the criminal order more compatible and aligned to the new values entered by the Federal Constitution of 1988. In this way, the research took place through the reading of criminal legal literature, the analysis of the jurisprudence of the Supreme Federal Court and the Superior Court of Justice, in addition to public data. Thus, the study reached the conclusion that it is unnecessary to criminalize conduct so little harmful that it cannot even be considered criminal, but mere misdemeanors, in addition, it was found that criminal misdemeanors are incompatible with the guiding principles of Minimum Criminal Law. Finally, it was concluded that the best solution for the problems pointed out during this research, is the edition of a law repealing the Decreto-Lei nº 3.688/41.
