Resumo: This work aims to study the applicability of the punitive damages in the Brazilian legal system. It is scrutinized, therefore, if it is possible, within Brazilian torts law, to order the agressor to pay compensation in excess of the required to repare the damages, in order to punish the unlawful activities and discourage similar new conducts. First of all, in order to do this, a historical analysis of the torts law is carried out, for the purpose of determining if the punitive damages are suitable with the paths taken in the last centuries by the torts law. Next, the purposes of the legal institute are studied, being pointed out which are the structures responsible for materializing it. Lastly, the inspirations of the brazilian punitive damages in the foreign law are investigated, being presented the main criticism of the use of this legal instrument in the Brazilian legal system, as well as the responses of the supporters of the general application of the private penalties.

Escrutiniza-se, portanto, a possibilidade de, no âmbito da responsabilidade civil, haver a condenação do agressor ao pagamento de indenização em valor superior ao necessário à mera reparação dos danos, com a finalidade de punir a atuação ilícita e desincentivar novas condutas semelhantes. Para isso, realiza-se, primeiramente, análise histórica da responsabilidade civil, a fim de determinar se a indenização punitiva se adequa aos caminhos percorridos nos últimos séculos pela responsabilidade civil. Em seguida, são estudadas as finalidades do instituto, apontando-se quais são as estruturas responsáveis por materializá-las.
