A iniciativa popular na constituição federal de 1988: comentários sobre a importância e eficácia como instrumento de democracia participativa

This essay approaches to an important political tool of popular participation, and of great republican value, the Direct Legislation. Once it is seen the failure of the Modero Constitutional State as a democratic way to rule the society, this paper spots the struggle for legitimacy in the Legislative Power. On the way to achieve that, popular sovereignty instruments of immediate intervention are created, howsoever, the reaction from conservatives in power is also immediate. Soon, they rise barriers against the truly effectiveness of those instruments. It is about this relationship between Direct Legislation and the political-ideological context that this text is dedicated. For that, this study is executed addressing the theoretical conceptions of democracy, sovereignty and legitimacy. Formal and others so called material difficulties about the utilization of the political tool are also presented. There is a debate about the measures indicated as appropriated for the tool's effectiveness and for the achievement ofwhat is believed to be an ideal of democratic regime, or the one more coherent with the contemporaneous social demands.
