Resumo: This thesis has as its object a critical study of the Brazilian Judiciary’s performance in face of legal disputes involving practices of bio-politics. Practices of bio-politics means the intervention of the State in which the basic biological features of the human being become part of a general strategy of power. The research is justified by the increase of legal disputes involving border scramble caused by biotechnology. Biotechnology is defined as any process leading to technological application in biological systems. These legal disputes require the Judiciary to produce a discourse about bio-politics. As a first hypothesis, the thesis considers that the definition of a state model is crucial to the expansion of bio-political practices. To test the first hypothesis, the thesis systematizes the concepts of the Rule of law, the theoretical proposals and the historical experiences of the liberal state, the social state, the totalitarian state and the security state, and investigates the Judiciary within these four mentioned features. As a second hypothesis, the thesis considers that the complexity around issues of bio-politics extends the possibilities of malfunction in law itself, which leads to difficulties in the Judiciary performance. In order to ratify the second hypothesis, this thesis presents the thoughts of Hannah Arendt, Michel Foucault and Giorgio Agamben, and systematizes the main discourses that contributed to “judicialize bio-politics”, which are the gender discourse, the humanizing function of the law (proposal formulated by legal contemporary Anthropology) and the juridical discourse of individual rights. Through a critical analysis of the reasoning of Court decisions, this thesis investigates what the Judges think about the Law, bio-politics and its problems, with qualitative analysis of decisions that affect human sexuality. The thesis concludes that the proposal of a security State extends spaces and opportunities for the practices of bio-politics. It also concludes that the complexity of the issues complicates the Judiciary’s performance, considering the Rule of law. This thesis aims at recovering the importance of the law as a tool to reduce complexity, reordering biological or moral arguments in this debate, with the purpose of producing judiciary decisions more in line with the framework of the rule of law.

Por práticas de biopolítica entendem-se as intervenções do Estado nas quais os traços biológicos fundamentais dos seres humanos tornam-se parte de uma estratégia geral de poder. A pesquisa justifica-se pelo aumento de controvérsias judiciais que envolvem embaralhamentos de fronteiras causados pela biotecnologia. Por biotecnologia entende-se qualquer processo que utilize aplicação tecnológica em sistemas biológicos. O aumento dessas controvérsias exige que o Poder Judiciário produza um discurso sobre a biopolítica. Como primeira hipótese, considera que a definição de um modelo de Estado é decisiva na ampliação das práticas da biopolítica. Para verificação da primeira hipótese sistematiza, a partir do conceito de Estado de Direito, as propostas teóricas e as experiências históricas do Estado liberal, do Estado social, do Estado totalitário e do Estado securitário, e investiga a atuação do Judiciário como instância decisional do Estado de Direito, nas quatro modalidades citadas. Como segunda hipótese, considera que a complexidade em torno das questões da biopolítica amplia as possibilidades de disfunções do próprio Direito, o que leva a dificuldades de atuação do Judiciário. Para a verificação da segunda hipótese apresenta o pensamento de Hannah Arendt, Michel Foucault e Giorgio Agamben, e sistematiza os principais discursos que contribuíram para judicializar a biopolítica, qual sejam, os discursos de gênero, a proposta da função humanizadora do Direito formulada pela antropologia jurídica contemporânea e o discurso jurídico dos direitos da personalidade. Por meio de uma análise crítica à fundamentação de decisões judiciais, investiga o que pensa o Judiciário brasileiro sobre o Direito, a biopolítica e seus problemas, em uma análise qualitativa das estratégias argumentativas de decisões sobre a sexualidade humana. Conclui-se que a proposta de um Estado securitário amplia espaços para as práticas da biopolítica e que a complexidade das questões dificulta a atuação do Judiciário no Estado de Direito. Propõe-se o resgate da compreensão da importância da lei como instrumento de redução de complexidades, o que reposiciona argumentos morais e biológicos, buscando viabilizar decisões judiciais mais adequadas à proposta de Estado de Direito.Cette thèse a pour objet une étude critique de la performance de l'appareil judiciaire brésilien face à des litiges impliquant des pratiques de la biopolitique . La pratique de la biopolitique signifie l'intervention de l'État dans lequel les caractéristiques biologiques de l'être humain font partie d'une stratégie générale de pouvoir. La recherche est justifiée par l' augmentation des litiges impliquant brouiller la frontière causés par la biotechnologie. La biotechnologie est définie comme un processus conduisant à l'application technologique dans les systèmes biologiques L'augmentation des contentieux juridiques exige la justice pour produire un discours sur la biopolitique . Comme une première hypothèse, estime que la définition d'un modèle d'état est décisif pour la expansion de pratiques de la biopolitique. Pour vérifier la première hypothèse, cette thèse systématise de la notion d' Etat de droit, les propositions théoriques et les expériences historiques de l'État libéral, l'État-providence , l'État totalitaire et d'État d'assurance, et étudie le rôle du pouvoir judiciaire en tant qu'organe de l'Etat, dans les quatre modalités mentionnées. Dans un deuxième hypothèse, estime que la complexité des questions autour de la biopolitique étend les possibilités du droit des dysfonctionnements elle-même, ce qui conduit à des difficultés dans la performance de l'appareil judiciaire . Pour vérifier la seconde hypothèse, présente la pensée de Hannah Arendt, Michel Foucault et Giorgio Agamben, et systématise les principaux discours qui ont contribué à judiciariser la biopolitiqe , qui sont le discours sur le sexe dnas la sociologie, la fonction proposée d'humaniser la loi formulée par l'anthropologie juridique et le discours juridique contemporaine des droits personnels . Faire une analyse critique de la motivation des décisions de justice, enquête sur ce qu'il pense de la loi et de driot les juges brésiliens, et aussi sur la biopolitique et de ses problèmes. Faire une analyse qualitative des stratégies argumentatives des décisions sur la sexualité humaine . Conclut que la proposition d'un État d'assurance amplifie opportunités pour les pratiques de la biopolitique. Conclut également que la complexité des questions complique les performances de l'appareil judiciaire , compte tenu de la règle de droit.
