This essay aims to analyze the evolution of Human Rights, in particular its branch that regulates and protects those who need to escape from their place of origin in search of other nations, since they are no longer able to survive (for social, political, ideological, etc. reasons) in their originating country, the International Refugee Law. In this sense, we tried to study the evolution of this legal branch from its beginnings to the present day, when a now form of refugee has been recognized: the Environmental Refugees, people who are no longer able to remain in their places of origin by reasons of environmental degradation, but still need international legal protection, existing a great divergence if they may or may not be considered refugees. Bibliographic sources were used, such as articles, books, news, conventions, and others that deal with the subject, covering three major areas of international law: Human Rights, the International Refugee Law and International Environmental Law. Finally, we expect to better understand the origin and dynamics of the treatment that the United Nations provides for Refugees, especially the environmental refugees, and to find out what role these forced migrants have in the socioeconomic and current international legal geopolitics.
