To do so, we analyze elements that permeate this relationship, such as the directive power of the employer and free initiative in tension and conflicts with the rights of the employee's personality. The objective is to analyze the possibilities and limitations of the fundamental right to religious belief, considering the guiding principles of labor relations. The research carried out has a theoretical, bibliographical and documentary character, emphasizing the use of literature focused on the interactions between labor law and religion, using also the legislative exposition and judgments on the subject in question. In order to carry out this study, one begins with the reflections of authors such as Ingo Sarlet, Gilmar Mendes, Paulo Branco and Paulo Bonavides, and also Aloisio Cristovam dos Santos Junior. The study analyzed the fundamental right to religious freedom as one of the formators of the personality and dignity of the human person, hence the importance of protecting it from restrictions due to the employee's hyposufficient situation in the working relationship. It is concluded that the directive power of the employer and the principle of free initiative should not overlap with the right of personality of the employee and, more specifically, the employee's right to exercise their religious beliefs in the workplace, taking into consideration the Rights constitutionally Protected in relation to the dignity of the human person, as well as those referring to the social function of the company. It was also found that the jurisprudence considers possible the condemnation of the employer to repair the off-balance sheet damages caused by moral harassment of religious character, since it is an unconstitutional discriminatory practice.O presente trabalho aborda interações e tensões existentes no ambiente laboral em relação à liberdade religiosa dos empregados e empregadores, refletindo acercas dos principais princípios que regem a relação jurídica do contrato de trabalho e o direito fundamental de exercer a livre manifestação de credo. Para tal, analisam-se elementos que permeiam essa relação, como o poder diretivo do empregador e a livre iniciativa na tensão e conflitos com os direitos da personalidade do empregado. Objetiva-se analisar as possibilidades e limitações do direito fundamental à crença religiosa, considerando os princípios norteadores das relações de trabalho. A pesquisa realizada tem caráter teórico, bibliográfico e documental, primando pela utilização de literatura voltada para as interações entre direito do trabalho e religião, valendose, ainda, da exposição legislativa e de julgados sobre a temática em questão. A fim de realizar esse estudo, parte-se das reflexões de autores, como Ingo Sarlet, Gilmar Mendes, Paulo Branco e Paulo Bonavides, e ainda Aloisio Cristovam dos Santos Junior. O estudo feito analisou o direito fundamental à liberdade religiosa como sendo um dos formadores da personalidade e dignidade da pessoa humana, daí a importância de protegê-lo frente a restrições em decorrência da situação hipossuficiente do trabalhador na relação de trabalho. Conclui-se que o poder diretivo do empregador e o princípio da livre iniciativa não devem se sobrepor ao direito de personalidade do empregado e, mais especificamente, sobre direito deste de exercer a manifestação de seu credo no ambiente laboral, levando-se em considerações os direitos constitucionalmente protegidos em relação à dignidade da pessoa humana, assim como aqueles referentes à função social da empresa o valor social do trabalho também estabelecido pela Carta Magna.
