Resumo: The article discusses LGBTI+ rights in Brazil, focusing on the judgment that criminalized LGBTIphobia and in dialogue with the sociopolitical context of a government that understood the LGBTI+ agenda as an enemy of the State. Its objective is to understand, based on three factors, the role of the Federal Supreme Court (STF) in its favorable positions, especially with regard to this judgment, which equated LGBTIphobia with the crime of racism. To this end, it reconstructs a history of actions linked to the LGBTI+ issue in the high court, in parallel with parliamentary and federal executive movements under bibliographical review and documentary research. It concludes that the main factor of understanding for the STF's progressive position is the sociopolitical context experienced by the country, in a scenario of rise and installation of a government with a conservative moral profile that antagonized the recognition of these rights.

Su objetivo es comprender, a partir de tres factores, el papel del Supremo Tribunal Federal (STF) en sus posiciones favorables, especialmente respecto de esta sentencia, que equiparó la LGBTIfobia con el delito de racismo. Para ello, recompone la historia de acciones vinculadas a la cuestión LGBTI+ en la suprema corte, en paralelo con movimientos parlamentarios y ejecutivos federales bajo revisión bibliográfica e investigación documental. Se concluye que el principal factor de comprensión para la posición progresista del STF es el contexto sociopolítico vivido por el país, en un escenario de ascenso e instalación de un gobierno con un perfil moral conservador que antagonizó el reconocimiento de estos derechos.O artigo discute os direitos LGBTI+ no Brasil, com enfoque no julgamento de 2019 que criminalizou a LGBTIfobia e em diálogo com o contexto sociopolítico de um governo que entendia a pauta LGBTI+ como inimiga do Estado. Seu objetivo é compreender, a partir de três fatores, a atuação do Supremo Tribunal Federal (STF) nos posicionamentos favoráveis, especialmente no que tange a esse julgamento, que equiparou a LGBTIfobia ao crime de racismo. Para tanto, recompõe o histórico de ações ligadas à questão LGBTI+ na alta corte, em paralelo com movimentações parlamentares e do executivo federal sob revisão bibliográfica e pesquisa documental.
