The present study demonstrates the importance of an Environmental Management System as a means of preventing environmental liabilities arising from Gas Stations activities. The business may not be feasible if these activities are not well managed. In this study, the author makes a brief explanation on the importance of the oil industry in the country, showing that the environmental impacts of these activities were not well known and, therefore, their consequences underestimated. Because of this, a large number of sites, especially gas stations, have soil and groundwater contamination with hydrocarbons products. He also discusses the critical success factors or consequences of inadequate environmental management of these activities, investigates its associated environmental impacts, relates them to the importance of preserving potable water, and presents a proposal to evaluate environmental damages of a case, which may serve as guidance to future indemnity claims, compensatory measures and environmental insurances. He demonstrates through a cost benefit analysis that a gas station retailer can implement a Simplified Environmental Management System, following current legislation and also contributing to its improvement, by having a participative discussion with all interested stakeholders. Following the guidelines of an Environmental Management System, the gas station retailer will avoid environmental damage to soil and groundwater, and, as a consequence: i) the business will not have additional costs to investigate and remediate environmental impacts; ii) to pay indemnities claimed by affected third parties which may be equivalent to the economic value of the damaged environmental asset (soil and groundwater); iii) fines for environmental crimes. The environmental management system of a gas station not only avoids future environmental liabilities, preserving soil and groundwater for future generations, but is also a guarantee of sustainability for the small gas station retailer
