Resumo: This article aims to understand the legal outline that the country has been granting water, correlating with the concept of development and water security. Therefore, discusses water as a commodity and as a human right and the effects of adopting these perspectives. In a dialectic exercise, bibliographic, documentary, legislative, and jurisprudence research was done. The methodology served to understand the process of monetizing water resources and the discourse that this is the only way to promote sustainable development and water security. Next, confronts the sustainability theory with the water conflicts that occur in Brazil. Thus, it is understood that the involvement must come before the development, so that man can consider nature in itself and not for himself. Therefore, in addition to security, it is necessary to think about water sovereignty. In summary, we seek to build a collective political and legal agenda that guarantees the right to water for all and respects the plurality of existing needs.

Con este fin, analiza el agua como una mercancía o como un derecho humano y los efectos de adoptar cada una de estas perspectivas. En un ejercicio dialéctico, se hace una investigación bibliográfica, documental, legislativa y jurisprudencial para comprender el proceso de monetización del agua y el discurso de que esta es la única forma de promover el desarrollo sostenible y la seguridad hídrica. Después, se enfrenta la teoría de sostenibilidad con los conflictos sobre el agua que ocurren en Brasil. Por lo tanto, se entiende que involucrarse debe venir antes de desarrollarse, para que el hombre pueda considerar la naturaleza por sí misma y no para ti. Además de la seguridad, es necesario pensar en la soberanía del agua, permitiendo que la sociedad participe de manera efectiva en la construcción de una agenda política y legal que garantiza el derecho al agua para todos y respete la pluralidad de las necesidades existentes.Este artigo tem o objetivo de compreender o delineamento jurídico que o país vem concedendo à água, realizando uma correlação com o conceito de des-envolvimento e de segurança hídrica. Para tanto, discute a água enquanto mercadoria ou como direito humano e os efeitos da adoção dessas perspectivas. Em um exercício dialético, realiza-se pesquisas bibliográfica, documental, legislativa e jurisprudencial com o intuito de entender o processo de monetarização da água e o discurso de que essa é a única forma de promover o desenvolvimento sustentável e a segurança hídrica. Em seguida, confronta-se a teoria da sustentabilidade com os conflitos por água que ocorrem no Brasil. Assim, entende-se que o envolver-se deve vir antes do desenvolver, de maneira que o homem possa considerar a natureza em si e não para si.
