THE ORGANIZED CRIME LAW AND ITS ADEQUACY WITH THE UNITED NATIONS CONVENTION AGAINST TRANSNATIONAL ORGANIZED CRIME

Resumo: The present paper aims to study the Criminal Organizations, law nº 12.850/13, and its adjustment to the Palermo’s Convention, to combat the growing threat of the organized crime. It Traces a history of the evolution of criminal organizations throughout history, the “classics organizations”, until it reaches the current setting of this criminal activity. It Analyzes the Palermo’s Convention, its context and its main devices, and comment on the laws that deal with the subject under discussion in the Brazilian legal system and lack of a definition of criminal organizations, until the Law 12.850/13. It Comments and also analyzes its sync with the Convention and discusses the effectiveness of Brazilian regulatory instruments against the great problem of the organized crime. It uses for this literature sources, approach employing inductive method and the monograph procedure.

Traça um histórico da evolução das organizações criminosas ao longo da história, as organizações “clássicas” até chegar à atual configuração dessa atividade criminosa. Analisa a Convenção de Palermo, seu contexto e seus principais dispositivos, além de comentar sobre as leis que versem sobre o assunto em comento no ordenamento jurídico brasileiro e o problema da falta de uma definição sobre organizações criminosas, até chegar na Lei 12.850/13. Comenta e analisa também a sua sincronia com a Convenção e discorre sobre a eficácia dos diplomas normativos brasileiros contra o grande problema do Crime Organizado.
