Resumo: The article analyzes the introduction of fundamental social rights in the Brazilian prison system. It asks, using the Brazilian penitentiary information of the country, to what extent the emergence of the Social State has affected the punitive system, especially in relation to the introduction and access to fundamental social rights in prisons? The research is justified in the constitutional commitment for the valorization of the fundamental rights (notably social) in the center of the Welfare State. First, it verifies the advent of the Welfare State and the constitutional trajectory. Afterwards, it examines the treatment and inclusion of fundamental social rights in Brazilian prisons from the nineteenth century. Then, it presents an overview about the access to fundamental social rights in the prison system. Finally, it evaluates the distance between the positivation of social rights and the Brazilian prison reality, characterized by the devaluation of the social rights of prisoners. The method used is the deductive, through the procedure of literature review and documentary research

Indaga, por meio do exame das informações penitenciárias do país, em que medida o surgimento do Estado Social impactou no sistema punitivo, especialmente em relação à introdução e o acesso aos direitos fundamentais sociais nas prisões? A pesquisa se justifica no compromisso constitucional de valorização dos direitos fundamentais, notadamente os sociais, no corpo do Estado Social de Direito. Primeiramente, verifica o advento do Estado Social e a trajetória constitucional. Após, examina o tratamento e a inclusão dos direitos fundamentais sociais nas prisões do país a partir do século XIX. A seguir, expõe um panorama sobre o acesso aos direitos fundamentais sociais no sistema prisional do país. Por fim, avalia a distância entre os direitos sociais positivados e o que ocorre na realidade prisional brasileira, caracterizada pela desvalorização dos direitos sociais das pessoas presas.
