Resumo: The need to protect innovation implies mechanisms to protect and foster innovation-based development. The Green Patents are analyzed as one of the suitable and appropriate mechanisms for the protection and promotion of Innovation with the environmental qualifier. This is an exemplary possibility of how the law can promote the necessary bridges between the dynamism of the economy and the innovation with the care with the environment, in a genuine situation of adaptation to the new demands imposed by the market and the society. Such probabilities will be verified through the deductive method of research as well as by reviewing relevant doctrinal aspects.

Diante desse fato, busca-se analisar as Patentes Verdes como um desses mecanismos, supostamente adequado a necessidade cada vez mais presente de proteção ambiental e que, em outras palavras, seria a análise da possibilidade do Sistema do Direito, conseguir produzir a necessária pontes entre o Sistema Econômico e o Sistema da Inovação, com o devido cuidado para com o Meio Ambiente, numa genuína situação de adaptação ambiental.
