Resumo: This work is part of the Research Line “Fundamentals of Educational Processes” of the Graduate Program in Education, at the Federal University of Goiás. The general objective was to understand the mediations between prohibition and neoliberalism, particularly with regard to the production, distribution and consumption of drugs in contemporary times. To achieve the objective proposed in this work, we developed a theoretical study based on the study of the relevant literature and institutional documents. We established the period between 1988 and 2019 as a historical outline, having as landmarks the 1988 UN Convention and the most recent Brazilian drug legislation, of 2019, and Decree nº 9.761, of April 2019, which provides for the National System Public Policy on Drugs. Marxist thought was adopted as a theoretical reference in this work, particularly Gramscian elaborations. The work analyzed the historical foundations of prohibitionism; the role of public health as one of the justifications for the prohibition; and the role of the capitalist state in controlling the ways of life of the subaltern classes, especially regarding the production, distribution and consumption of drugs. In an effort to apprehend the determinations of the ways of controlling the production of drugs under neoliberalism, we sought in the historical bases of the construction of the capitalist state the foundations of these forms of control, understood here as part of the establishment of bourgeois hegemony and as an expression of class struggles. In Brazilian historical particularity, contemporary prohibitionism, under the neoliberal aegis, plays an important role in bourgeois hegemony, accentuating its domination over the subaltern classes, with a strong racial profile. Especially after Law n. 11,343 / 2006, the incarceration processes linked to laws to control the production, distribution and consumption of drugs grew independently of the political and ideological positions of the later governments. With the institutional rupture that occurred in 2016, when President Dilma Rousseff was impeached, and the subsequent changes in drug laws, it is important to evaluate future developments.

O objetivo geral foi compreender as mediações entre o proibicionismo e o neoliberalismo, particularmente no que se refere à produção, distribuição e consumo de drogas na contemporaneidade. Para atingir o objetivo proposto neste trabalho, desenvolvemos um estudo teórico com base no estudo da literatura pertinente e de documentos institucionais. Estabelecemos como recorte histórico o período compreendido entre 1988 e 2019, tendo como marcos a Convenção da ONU de 1988 e a mais recente legislação brasileira sobre drogas, de 2019, e a Lei 13.840, de 05 de junho de 2019, que dispõe sobre o Sistema Nacional de Políticas Públicas sobre Drogas. O pensamento marxista foi adotado como referencial teórico neste trabalho, particularmente as elaborações gramscianas. O trabalho analisou os fundamentos históricos do proibicionismo; o papel da saúde pública como uma das justificativas para a proibição; e o papel do Estado capitalista no controle dos modos de vida das classes subalternas, em especial quanto à produção, distribuição e consumo de drogas. No esforço de apreender as determinações das formas de controle da produção das drogas sob o neoliberalismo, buscamos nas bases históricas de construção do Estado capitalista os fundamentos destas formas de controle, compreendidas aqui como parte do estabelecimento da hegemonia burguesa e como expressão das lutas de classes. Na particularidade histórica brasileira, o proibicionismo contemporâneo, sob a égide neoliberal, cumpre papel importante na hegemonia burguesa, acentuando seu viés de dominação sobre as classes subalternas, com forte recorte racial. Em especial a partir da Lei Nº 11.343/2006, os processos de encarceramento ligados às leis de controle da produção, distribuição e consumo de drogas cresceram independente das posições políticas e ideológicas dos governos posteriores.
