Resumo: The object of this article is the performance of the Judiciary and starts from the hypothesis that it is controlled by an external element that is ideology. The general objective is to analyze how the Judiciary works in the capitalist order. The specific objective is to analyze the reflection of the Judiciary’s performance on the academic environment and teaching work. We opted for the inductive method based on the specific premise that it was a decision that censored a course on the 2016 coup d’état in Brazil at the State University of Mato Grosso do Sul for a general premise that allows us to understand the functioning of the Judiciary within capitalism. The conclusion pointed out that in 2016 the elites carried out a coup d’état in Brazil and still conducted the narrative of the facts through the Judiciary used to legitimize the process.

A hipótese é de que apesar do princípio de independência do judiciário, por vezes, sua atuação seja controlada por um elemento externo que é a ideologia. O objetivo geral é analisar como o Judiciário funciona na ordem capitalista contemporânea. O objetivo específico é averiguar eventuais reflexos da atuação do Judiciário sobre o ambiente acadêmico especificamente no que se refere ao trabalho docente.
