Practices of the forum shopping between the WTO and the FTA: the value of the principle of res judicata in the settlement of disputes

Resumo: In the context of economic globalization there is a great propensity to conflicts or overlaps between the international agreements, of its obligations or rights and even their jurisdictions. The analysis of these phenomena becomes more complex when taking into account the current proliferation of international instruments of commercial nature (preferential agreements, free trade areas, customs unions, etc.), each with a mechanism for dispute settlement, and these international instruments can generate conflicts or overlaps with the legal framework of the WTO. With an aspect to consider, there is no hierarchical relationship of a source of legal production on another (as if it is under domestic law), unless expressly provided for in an instrument or can be deduced from implicitly its normative content through an interpretive activity. From the wide range of instruments governing international trade, this discussion will focus on the analysis of the conflict rules incorporated in the various Free Trade Agreements (FTA) concluded between Latin American countries and the United States, specifically the NAFTA, the FTA with Chile, the CAFTA-DR, the FTA with Peru, the FTA with Colombia and the FTA with Panama, also the Economic Partnership Agreement (EPA) of Latin American countries and the European Union, including the EPA with Mexico, the EPA with Chile and the EPA with the Andean countries, in addition will be reviewed the conflict rules of the WTO law. In the end, will conclude on the usefulness of the principle of res judicata to resolve the effects of forum shopping.

El análisis de estos fenómenos se hace más complejo si se tiene en cuenta la actual proliferación de instrumentos internacionales de naturaleza comercial (acuerdos preferenciales, zonas de libre comercio, uniones aduaneras, etc.), cada uno, con un mecanismo de solución de controversias que puede llegar a generar conflictos o superposiciones con el régimen jurídico de la OMC. Con un aspecto a tener en cuenta, no existe una relación de jerarquía de una fuente de producción jurídica sobre otra (como en si ocurre en el Derecho interno), a menos que esté contemplada de forma expresa en un instrumento o que se pueda deducir de forma implícita de su contenido normativo por medio de una actividad interpretativa. Del amplio abanico de instrumentos que regulan el comercio internacional, esta disertación centrará su atención en el análisis de las normas de conflicto incorporadas en los diferentes tratados de libre comercio (en adelante TLC) celebrados entre países latinoamericanos y los Estados Unidos, concretamente, el TLC de América del Norte de 1994, el TLC con Chile de 2004, el TLC con la República Dominicana y Centroamérica de 2006, el TLC con Perú de 2009, el TLC con Colombia de 2012 y el TLC con Panamá de 2012, además, los Acuerdos de Asociación Económica de países latinoamericanos y la Unión Europea, entre ellos, el TLC con México en 2000, el TLC con Chile de 2005 y el TLC con los países andinos de 2013, finalmente, se incluirá en el examen las normas de conflicto del régimen jurídico de la OMC, y así se llegará a concluir la utilidad que puede tener el principio de la cosa juzgada o res judicata respecto a los efectos del fórum shopping.Não há dúvida de que, no contexto da globalização econômica, há uma grande disposição para conflitos ou sobreposição de instrumentos internacionais, suas obrigações ou direitos e até mesmo suas jurisdições. A análise destes fenômenos torna-se mais complexa se levarmos em conta a atual proliferação de instrumentos internacionais de natureza comercial (acordos preferenciais, zonas de livre comércio, uniões aduaneiras, etc.), cada um com um mecanismo de solução de controvérsias que pode até gerar conflitos ou sobreposições com o regime jurídico da OMC. Com um aspecto a ter em conta, não há hierarquia de uma fonte de produção legal sobre outra (como no caso do direito interno), a menos que esteja expressamente previsto num instrumento ou possa ser implicitamente inferido a partir do seu conteúdo normativo por meio de uma atividade interpretativa.
