Resumo: | This analysis aims to contribute to the debate on the implementation of Chinese extractive corporations in Latin America. While the Beijing regime and partners in the region publicize that these investments are part of a supposed win-win cooperation in the context of the Belt and Road Initiative, the pattern of negative effects of these extractive activities on human rights and the environment point to a reissue of abusive practices against the affected communities, which has come to be described as a new colonialism with Chinese characteristics. At the same time, these cases only confirm the gaps in international law and the limits of the different soft-law initiatives (from the Guiding Principles to the National Action Plans) to be able to denounce the abuses of the activities of transnational corporations, and consequently, demand responsibilities. |
