Resumo: This analysis aims to contribute to the debate on the implementation of Chinese extractive corporations in Latin America. While the Beijing regime and partners in the region publicize that these investments are part of a supposed win-win cooperation in the context of the Belt and Road Initiative, the pattern of negative effects of these extractive activities on human rights and the environment point to a reissue of abusive practices against the affected communities, which has come to be described as a new colonialism with Chinese characteristics. At the same time, these cases only confirm the gaps in international law and the limits of the different soft-law initiatives (from the Guiding Principles to the National Action Plans) to be able to denounce the abuses of the activities of transnational corporations, and consequently, demand responsibilities.

Mientras por parte del régimen de Beijing y socios en la región publicitan que estas inversiones se enmarcan en una supuesta cooperación win-win en el contexto de la Iniciativa de la Franja y la Ruta (Belt and Road Initiative, BRI), el patrón de los negativos efectos de estas actividades extractivas sobre los derechos humanos y el medio ambiente apuntan a una reedición de unas prácticas de abusos a las comunidades afectadas, que se ha llegado a calificar como un nuevo colonialismo con características chinas. Al mismo tiempo, estos casos no hacen sino constatar las lagunas del derecho internacional y los límites de las distintas iniciativas de soft-law (desde los Principios Rectores a los Planes de Acción Nacional) para poder denunciar los abusos de las actividades de las empresas transnacionales y en consecuencia, exigir responsabilidades.Esta análise visa contribuir para o debate sobre o estabelecimento de corporações extrativistas chinesas na América Latina. Enquanto o regime de Pequim e os parceiros da região divulgam que esses investimentos fazem parte de uma suposta cooperação win-win no contexto da Iniciativa do Cinturão e Rota (BRI), os efeitos negativos dessas atividades extrativistas sobre os direitos humanos e o meio ambiente apontam para uma reedição de práticas abusivas contra as comunidades afetadas, o que passou a ser descrito como um novo colonialismo com características chinesas.
