Resumo: This paper is intended to offer a comparative analysis of the main advances in the effective compliance with the United Nations Guiding Principles on Business and Human Rights. Although without forgetting the consequent impulse of public policies and self-regulation mechanisms, particular attention will be paid to their use as a basis for legislative initiatives and jurisdictional resolutions both at the national and international levels. The final objective is, therefore, to justify the understanding of the so-called ‘Ruggie Principles’ as a new manifestation of an emerging Global Law.

Aunque sin olvidar el consecuente impulso de políticas públicas y de mecanismos de autorregulación, se prestará especial atención a su utilización como fundamento de iniciativas legislativas y de resoluciones jurisdiccionales tanto a nivel nacional, como internacional. Y ello con el objetivo final de justificar el entendimiento de los denominados “Principios Ruggie” como una nueva manifestación de un emergente Derecho Global.Este artigo visa oferecer ao leitor uma análise comparativa dos principais avanços no cumprimento efetivo dos Princípios Orientadores das Nações Unidas sobre Empresas e Direitos Humanos. Sem esquecer a consequente promoção de políticas públicas e mecanismos de auto-regulamentação, será dada especial atenção à sua utilização como base para iniciativas legislativas e resoluções jurisdicionais, tanto a nível nacional como internacional.
