It seeks to analize the public hearing “Direitos Humanos e Empresas: qual é a política pública que o Brasil precisa?”, with focus in its possible conclusions. For this purpose, It considers theoretical analyzes on the subject such as the notion architecture of impunity developed by Juan Zubizarreta, and the inequality between the actors in that field, compared by Luiz Carlos Silva Jr. to the battle David against Goliath. In addition, there is the dispute over the legislative frameworks on the subject between the Guiding Principles, on a voluntary basis, and a binding international instrument. All these points were present in the speeches made at the analyzed event that concluded on the need to the construction of a public policy that stipulates binding norms on human rights and companies.
