The upcoming International Treaty on Business and Human Rights and Its potencial impacts on the Brazilian legal system

Resumo: The present work approaches the implementation of the forthcoming International Treaty on Business and Human Rights, still under development, and its possible impact on Brazil. For this purpose, the universal Human Rights system is brought to light, with an emphasis on the theme of Business and Human Rights. It also analyzes the content and context of the draft of the International Treaty on Business and Human Rights. Then, the current Brazilian norms and guidelines on the subject are identified in order, at the end, to present the potential effects of the eventual International Treaty in Brazil, from the second draft version presented in 2020. For this purpose, a bibliographic review on the universal Human Rights system and the study of violations of these Human Rights by companies were used, as well as the documentary analysis of the preexisting regulations in the Brazilian legal system. Based on these exploratory exercises, it is concluded that, despite bringing an innovation for holding States responsible and seeking to guarantee access to justice and remedies, the Treaty under study is not sufficient to solve the problem of the necessary accountability of companies, given the lack of other effective Brazilian regulations, seen the current voluntarist aspect of the current ones.

En esta línea, se aborda el Sistema Universal de Protección de los Derechos Humanos, con énfasis en el tema de las empresas y los derechos humanos. También analiza el contenido y contexto del borrador del Tratado Internacional sobre Empresas y Derechos Humanos. Entonces, se identifican las normas y lineamientos brasileños vigentes en la materia para al final, presentar los potenciales efectos del eventual Tratado Internacional de Empresas y Derechos Humanos en Brasil, a partir del segundo borrador presentado en 2020. Para ello se utilizó una revisión bibliográfica sobre el Sistema Universal de Protección de los Derechos Humanos y el tema de las violaciones de estos derechos humanos por parte de las empresas, así como un análisis documental de las normas preexistentes en el ordenamiento jurídico brasileño. A partir de estos ejercicios exploratórios, se concluye que, a pesar de traer una innovación para responsabilizar al Estado y buscar garantizar el acceso a la justicia y a los recursos, el Tratado en estudio no es suficiente para resolver el problema de la necesaria rendición de cuentas de las empresas, dada la falta de otras regulaciones brasileñas efectivas además del carácter voluntarista actual.O presente trabalho trata da implementação do futuro Tratado Internacional sobre Empresas e Direitos Humanos, em desenvolvimento, e seu eventual impacto no Brasil. Nesse viés, traz-se à luz o sistema universal de proteção aos Direitos Humanos, com ênfase na temática de empresas e Direitos Humanos. Analisa-se, ainda, o teor e contexto do rascunho do Tratado Internacional sobre Empresas e Direitos Humanos. Em seguida, identificam-se as atuais normativas e diretrizes brasileiras acerca da temática para, ao fim, apresentar os potenciais efeitos do eventual Tratado Internacional sobre Empresas e Direitos Humanos no Brasil, a partir da segunda versão de rascunho apresentada em 2020. Foram utilizados, para tanto, a revisão bibliográfica sobre o sistema universal de proteção aos Direitos Humanos e o tema de violações desses direitos humanos por empresas, e a análise documental das normativas preexistentes no ordenamento jurídico brasileiro.
