Human Rights standards and Business in contexts of profound inequality: chinese guidelines and mega-projects in Latin America

Resumo: The Belt and Road Initiative, a global infrastructure investment project sponsored by China, has generated high expectations in the recipient countries because of the economic benefits it could generate; but environmental activists and indigenous organizations have also expressed their concerns about its potential social and environmental impacts. This is accentuated by the absence of a clear international framework defining corporate obligations in terms of respect for the human and environmental rights of local populations. Based on an analysis of Chinese policies and guidelines on human rights and business, the impacts of its investments in Latin America, and the case study of the Hidrovía Amazónica project in the Peruvian Amazon, this article discusses the disconnect between human rights standards and specific corporate practices, especially with regard to indigenous rights to self-determination, free, prior and informed consent, and respect for ancestral knowledge. Through social processes of advocacy and questioning of projects, as well as appropriation of human rights standards, indigenous peoples make these standards binding in practice.

Ello se acentúa debido a la ausencia de un marco internacional claro que defina las obligaciones empresariales en materia del respeto a los derechos humanos y ambientales de las poblaciones locales. A partir de un análisis de las políticas y directrices chinas sobre derechos humanos y empresas, los impactos de sus inversiones en América Latina, y el caso de estudio del proyecto Hidrovía Amazónica en la Amazonía Peruana, el presente artículo discute la desvinculación entre estándares de derechos humanos y prácticas corporativas concretas sobre todo en lo que respecta a los derecho indígenas a la autodeterminación, el consentimiento libre, previo e informado, y el respeto del conocimiento ancestral. A través de procesos sociales de incidencia y cuestionamiento de los proyectos, así como de apropiación de los estándares de derechos humanos, los pueblos indígenas convierten estos estándares en obligatorios en la práctica.A Belt and Road Initiative, um projeto global de investimento em infra-estrutura patrocinado pela China, gerou grandes expectativas nos países beneficiários quanto aos benefícios econômicos que poderia gerar; mas os ativistas ambientais e as organizações indígenas também levantaram preocupações quanto a seus potenciais impactos sociais e ambientais. Isso é acentuado pela ausência de um marco internacional claro que defina as obrigações corporativas de respeitar os direitos humanos e ambientais das populações locais. Com base em uma análise das políticas e diretrizes chinesas sobre Direitos Humanos e Empresas, os impactos de seus investimentos na América Latina e o estudo de caso do projeto Hidrovía Amazónica na Amazônia peruana, este artigo discute a desconexão entre as normas de direitos humanos e práticas empresariais específicas, particularmente no que diz respeito aos direitos indígenas à autodeterminação, ao consentimento livre, prévio e informado, e ao respeito ao conhecimento ancestral.
