Blind spot of the international human rights law: overcoming the statocentric paradigm and the international accountability of human rights violator companies

Resumo: The contemporary scenario of the International Human Rights Law is still primarily related to the state and its liability, based in a state-centered view. In this respect, while the rules of jus cogens give dynamism to the international field, they also contribute to its evolution towards individual protection. Considering serious human rights violations perpetrated by transnational corporations, private relations become bounded by the mentioned mandatory rules. Thus, it is possible to notice the engagement of international organizations in this sense, standing out the UN's role about the issue of human rights and business. It is, therefore, imperative to interpret the International Human Rights Law as living corpus juris, in order to include companies as formal subjects of rights and duties.

En este sentido, mientras las normas de ius cogens dan dinamismo al ámbito internacional, contribuyen también para su evolución en beneficio de la persona humana. Frente a las graves violaciones de derechos humanos perpetradas por empresas transnacionales, relaciones privadas comienzan a ser englobadas por mencionadas normas imperativas. Con eso, se percibe el movimiento de las organizaciones internacionales en este sentido, destacándose el papel de la ONU en la cuestión de derechos humanos y empresas. Se muestra imperativo, por lo tanto, interpretar el Derecho Internacional de los Derechos Humanos como corpus juris vivo, a fin de incluirse empresas como sujetos formales de derechos y obligaciones.O cenário contemporâneo do Direito Internacional dos Direitos Humanos ainda se volta primacialmente à figura do Estado e de sua responsabilização, numa visão estatocêntrica. Neste tocante, enquanto as normas de jus cogens conferem dinamicidade à seara internacional, contribuem também para a sua evolução em prol da pessoa humana. Frente às graves violações de direitos humanos perpetradas por empresas transnacionais, relações privadas passam a ser abarcadas por mencionadas normas imperativas. Com isso, percebe-se o movimento das organizações internacionais neste sentido, destacando-se o papel da ONU na questão de direitos humanos e empresas.
