Resumo: | This essay analyzes the balancing of constitutional principles when conflicts between Public Administration and Companies interests occur, focusing state’s interventionism as modality of market regulation. Economic sector is stage of constant battles between public and private interests. Economics policies represent a major role in solving those conflicts, acting like the real fundament of constitutional principles’ balancing in order to solve the concrete cases, once those policies represent a market regulation factor. In this order, in the comprehension of Brazilian post neoliberal State, the Executive and Legislative Powers make economic interventions in order to guarantee profits, while the Judiciary, handling out decisions that fuses the primaries and the secondaries public interests, guaranties the supremacy of Public Administration over the private initiative. |

A economia é palco de constantes embates entre os interesses público e privado. Na leitura pretendida, a política econômica representa papel preponderante na solução desses conflitos, atuando como norte da ponderação de princípios constitucionais no deslinde de embates concretos, porquanto fator de regulação do mercado.
