A tutela jurisdicional dos trabalhos sexuais no direito brasileiro

Resumo: O presente trabalho tem o objetivo de realizar um breve mapeamento sobre como o direito brasileiro tutela as demandas que circundam os trabalhos sexuais. Assim, desenvolve-se o tema em três vias principais: a primeira diz respeito ao conceito desta atividade laboral, bem como as atividades por ele englobadas, a fim de balizar o objeto que será tratado. A segunda buscará expor a forma com que direito positivo brasileiro, bem como parte da jurisprudência, trata o tema, em especial nas esferas trabalhista e penal, pontuando eventuais incoerências nesse trato. Por fim, em caráter mais conclusivo, será realizada uma breve crítica a respeito da realidade observada, questionando o porquê do direito ainda se mostrar tão inerte frente à realidade dessas profissões e de seus trabalhadores, buscando levantar hipóteses e propor mudanças de atitude a fim de fornecer uma maior proteção legal aos direitos dessas pessoas. A metodologia adotada é a da pesquisa bibliográfica, em relação à literatura especializada sobre o tema; e pesquisa documental, em relação à legislação e jurisprudência.

The theme is developed in three main ways: the first concerns the concept of this work activity, as well as the activities encompassed by it, in order to mark the object that will be treated. The second will seek to expose the way in which positive Brazilian law, as well as part of the jurisprudence, addresses the issue, especially in the labor and penal spheres, punctuating any inconsistencies in this deal. Finally, in a more conclusive character, a brief criticism will be made regarding the observed reality, questioning why the law still so inert in the face of the reality of these professions and their workers, seeking to raise hypotheses and propose changes in attitude in order to provide greater legal protection for these people's rights.
