Resumo: O presente trabalho tem a pretensão de analisar tanto o instituto da reincidência quanto o dos maus antecedentes em busca de incongruências em relação à Constituição da República e aos princípios básicos como o da razoabilidade, presunção de inocência e non bis in idem. Assim, a partir da conceituação dos referidos institutos, seja pela lei seja pela doutrina, será analisada a aplicação dos aludidos institutos, observando-se as orientações diversas doutrinárias e jurisprudenciais sobre o tema.
