Judicialization of public policies in education in Brazil: a current phenomenon

Resumo: This article aims to discuss the concept of judicialization and its effects and influence over the public policies, especially those integrating the educational field. Regarding to the judicialization, the main goal here is to present considerations and reflections on its both origin and rise in the public debate, covering public policies of educational scope. Also it intends to address the force exerted by judicialization in the cycle of public policies and the role played by the institutions of the justice system in the process of judicialization of public policies of education, as all the Public Defender's Office, the Public Prosecutor's Office and the Federal Supreme Court have the potential to interfere in matters related to public policies. Finally, it aims to broaden the discussion on the marks of judicialization in public education policies presenting the main transformations in the educational area driven by the Brazilian 1988 Constitution.

En cuanto a la judicialización, el objetivo es presentar consideraciones y reflexiones sobre su origen y su auge en el debate público que abarca las políticas públicas en el campo educativo. Este trabajo también pretende abordar la fuerza que ejerce la judicialización en el ciclo de las políticas públicas y el papel que juegan las instituciones del sistema de justicia en el mencionado proceso de judicialización, al fin y al cabo, la Defensoría Pública, el Ministerio Público y el Tribunal Supremo Federal. tienen potencial para actuar e interferir en temas relacionados con las políticas públicas. Finalmente, este artículo tiene como objetivo ampliar la discusión sobre las marcas de la judicialización en las políticas públicas de educación presentando las transformaciones en el área educativa impulsadas por la Constitución de 1988.O presente artigo visa discorrer sobre o conceito de judicialização e seus efeitos e influência nas políticas públicas, sobretudo nas que integram o campo da educação. No que tange à judicialização, objetiva-se apresentar considerações e reflexões sobre sua origem e sua ascensão no debate público abrangendo políticas públicas de âmbito educacional. Este trabalho pretende também abordar a força exercida pela judicialização no ciclo de políticas públicas e o papel desempenhado pelas instituições do sistema de justiça no processo de judicialização citadas, afinal Defensoria Pública, Ministério Público e Supremo Tribunal Federal detêm potencial para agir e interferir nas questões referentes às políticas públicas.
