Resumo: Having the acknowledge of the Judiciary power as an important means of pursuing the effectiveness of the fundamental and social rights, fixed by the 88's Brazilian Federal Constitution, especially related to access to health, the current work aims to analyzing the growing process of health judicialization, as well as the hindrances and the consequences of this intervention. For that, the concepts linked to access to health, mainly related to public health, are approached. As a means of comprehension of the subject, it is discussed the issues that limit the complete performance of the Judiciary aiming to assure effectiveness to access to health. Hence, it will be analyzed whether proportionality and its subregras would be applicable forms to the Judiciary so that there is balance in the decisions and solutions of possible conflicts of norms that may arise with the judicial demands for the guarantee of the right to health

Para tanto, serão abordados os conceitos interligados ao direito à saúde, principalmente os que tangem à saúde pública. Como forma de compreensão do tema, serão discutidas questões que se mostram limitadoras da plena atuação do Judiciário no intuito de garantir efetividade a este direito.
