Resumo: Based on the hypothesis that a state scenario of incentive to comply with laws and regulations incompanies (compliance) aiming to frustrate predatory profi t-making, culminated in social responsibility actions translated into situations that are characterized as privatization of education, creating a simultaneous process of eff ectiveness and annulment of rights, this article aims to discuss the aforementioned antagonism, problematizing the format of the relation established between compliance and education. Through an interdisciplinary dialogue, we explore the central issue of the problem, the key concepts, and discuss, based on the US public function theory, ways of reversing a collision of eff ectiveness and loss of rights, especially the fundamental right to a public, secular and socially referenced education.
