No julgamento da ADPF 153, o Supremo Tribunal Federal enfrentou uma questão delicada: é constitucional a disposição da Lei de 1979, que anistiou crimes políticos e conexos praticados no período de 1961 a 1979? O resultado desse julgamento gerou muita polêmica e o tema poderá, em um futuro próximo, voltar à pauta de julgamentos da Corte. Uma reavaliação crítica e aprofundada de tal julgamento é, por isso, necessária. Essa é a proposta deste texto.PALAVRAS-CHAVE: Controle de constitucionalidade. Anistia. Justiça de transição. ABSTRACTAt trial of ADPF 153, the brazilian Supreme Court faced a delicate question: it is to consider as valid the provision of the Law of 1979, which granted political amnesty to crimes committed in the period 1961-1979? The result of this trial generated much controversy and this subject may, in the near future, come back to Courts agenda.
