Este artigo procura abordar a relação entre o conceito de Estado de Direito e a trajetória de aquisição de direitos na América Latina, relacionando as particularidades desse caso com o modelo ocidental (europeu e norteamericano) e discutindo as alternativas geradas pela noção de Estado Democrático de Direito frente às deficiências do processo latino-americano de aquisição de direitos civis, políticos e sociais. Primeiramente, far-se-á uma abordagem sobre os avanços e limites da ideia de Estado de Direito à luz da trajetória de aquisição de direitos das sociedades ocidentais. Posteriormente, a discussão se direciona para a América Latina, mostrando que o processo de aquisição de direitos na região foi inverso ao modelo ocidental e marcado por falhas ainda presentes na garantia de direitos civis, políticos e sociais. Por fim, frente às particularidades do caso latino-americano, sustenta-se que a ideia de Estado Democrático de Direito possibilita uma discussão mais ampla e integrada da questão e a possível superação das deficiências do processo de aquisição de direitos ao permitir, de forma conjunta, esforços para a melhoria dos direitos supracitados na região, inclusive os direitos sociais. Tais direitos estão diretamente relacionados com o avanço e a sustentabilidade da democracia na América Latina.PALAVRAS-CHAVE: Estado de Direito. Democracia. Direitos dos cidadãos. ABSTRACTThis article seeks to address the relationship between the concept of rule of law and the trajectory of acquisition of rights in Latin America, relating the particulars of this case to the Western model (European and North-American) and discussing the alternatives generated by the notion of a democratic state in the face of deficiencies Latin American process of acquisition of civil, political and social rights. First, one approaches the progress and limits of the idea of rule of law in the light of the trajectory of Western societies. Subsequently, the discussion is directed to Latin America, showing that the process of acquiring rights in the region was opposite to the Western model and marked by failures still present in guaranteeing civil, political and social rights. Finally, in the face of the characteristics of the Latin American case, one argues that the idea of a democratic rule of law provides a more comprehensive and integrated discussion of the issue and can overcome the shortcomings of the process of acquiring rights. It allows joint efforts for the improvement of rights in the region, including social rights. Such rights are directly related to the advancement and sustainability of democracy in Latin America.KEYWORDS: Rule of Law. Democracy. Democratic State. Latin American. Rights of citizens.
