Resumo: The article 293 of the United Nations Convention on the Law of the Sea (UNCLOS or Convention) deals with the applicable law to courts and tribunals under the Convention. However, the limits of its interpretation are still controversial regarding its use as a jurisdictional clause. Despite the jurisdiction rules specified in article 288 of UNCLOS, courts and tribunals have been awarding different decisions regarding this use, sometimes entertaining the claims, sometimes dismissing it. The present work is devoted to analyzing which of the interpretations on this matter is more adequate regarding conferring stability to the dispute settlement mechanism established by the Convention.

A pesar de las normas de jurisdicción especificadas en el artículo 288 de la CNUDM, los tribunales han decidido de manera diferente sobre este uso del artículo 293 de la Convención, a veces admitiendo la reclamación, a veces rechazándola. Mientras tanto, este artículo propone investigar qué interpretación es la más adecuada para conferir estabilidad al mecanismo de solución de controversias establecido por la Convención.O artigo 293 da Convenção das Nações Unidas sobre o Direito do Mar (UNCLOS ou Convenção) trata do direito aplicável às cortes e tribunais previstos na Convenção.  No entanto, os limites da interpretação deste dispositivo se demonstram, ainda, controversos quanto ao seu uso como cláusula jurisdicional. Apesar das regras de jurisdição especificadas no artigo 288 da UNCLOS, cortes e tribunais têm decidido diversamente sobre esta utilização do art. 293 da Convenção, ora admitindo a demanda, ora rejeitando-a.
