From security measures to mass incarceration policies: the reality of non-accountable persons in the legal system and in custody hospitals in the Brazilian context

Resumo: the work deals the issue of security measures, evaluating the situation of non-accountable individuals not only in the country's legal system, but also with regard to the processes of deprivation of liberty, which involves observing the experiences of these individuals in custody hospitals. Taking as a focus of analysis the realities available in Rio Grande do Sul, the reflection combines two perspectives: (i) on the one hand, it seeks to understand the theme of non-accountability in its legal aspects, proposing an understanding not only about its legal basis, but especially with regard to the controversies between security measures and the guarantee of fundamental rights - case of incompatibilities between such devices and mental health policies; (ii) in another way, the realities of the unputable in custody hospitals are assessed, verifying the conditions of approximation between the processes of deprivation of liberty and the guarantees of human rights and dignity. Although our analyze signal a situation in which new legal provisions and agencies committed to the approximation between security measures and the prerogatives of Human Rights are combined, there is a persistence of realities linked to a bureaucratic apparatus that still operates according to the logic of policies of mass incarceration.

Tomando como foco de análisis las realidades disponibles en Rio Grande do Sul, la reflexión combina dos perspectivas: (i) por un lado, busca comprender el tema de la inimputabilidad en sus aspectos jurídicos, proponiendo una comprensión tanto de su base legal como de las controversias entre las medidas de seguridad y la garantía de los derechos fundamentales - el caso de las incompatibilidades entre tales dispositivos y las políticas de salud mental; (ii) por otro lado, evalúa las realidades del inimputable en los hospitales de custodia, verificando las condiciones de aproximación entre los procesos de privación de libertad y las garantías de los derechos y la dignidad humana. Aunque nuestro análisis señala una situación en la que se combinan nuevos dispositivos legales y agenciamientos comprometidos con la aproximación entre las medidas de seguridad y las prerrogativas de los derechos humanos, se constata la persistencia de realidades vinculadas a un aparato burocrático que aún opera según la lógica de las políticas de encarcelamiento masivo.o trabalho aborda a questão das medidas de segurança, avaliando a situação dos inimputáveis não apenas no ordenamento jurídico do país, mas ainda no que se refere aos processos concretos de privação de liberdade, o que envolve observar as experiências desses sujeitos em hospitais de custódia. Tomando como foco da análise as realidades disponíveis no Rio Grande do Sul, a reflexão combina duas perspectivas: (i) por um lado, busca-se compreender a temática da inimputabilidade em seus aspectos jurídicos, propondo-se um entendimento tanto sobre sua base legal quanto sobre as controvérsias entre as medidas de segurança e a garantia de direitos fundamentais – caso das incompatibilidades entre tais dispositivos e as políticas de saúde mental; (ii) por outra via, avalia-se as realidades dos inimputáveis nos hospitais de custódia, verificando-se as condições de aproximação entre os processos de privação de liberdade e as garantias de direitos e de dignidade da pessoa humana.
