Neoliberalism, corruption and penal system: a symbiotic relationship

Resumo: This article aims to reflect on the existing feedback relationship between neoliberalism, corruption and the penal system. Corruption today is publicized as the worst evil in the country, responsible for the social ills that the population experiences, and which, for this reason, must be fought in an uncompromising way. For this combat, the penal system is activated, which would have the supposed function of suppressing it. However, what is not discussed is the neoliberal system, which contributes and often promotes corruption, and which, by using the penal system, far from eradicating corruption, creates more favorable conditions for the achievement of neoliberal policies. In order to discuss this issue, firstly, the problem about the concept of corruption is briefly exposed. Later, it talks about neoliberalism, relating it to corruption and the penal system. The last part of the work discusses the criminalization of corruption and its social effects. Finally, in the final considerations, we briefly resume what has been discussed and seek to demonstrate the correlation between neoliberalism, corruption and the penal system, and the way in which they support the existence of one and the other. The bibliographic review procedure was used to situate, investigate and interpret the problem, using as a reference the works of academics, sociologists and criminologists who critically deal with the topic addressed.

La corrupción hoy es publicitada como el peor mal del país, responsable de los males sociales que vive la población, y que, por ello, debe ser combatida de manera intransigente. Para este combate se activa el sistema penal, que tendría la supuesta función de suprimirlo. Sin embargo, lo que no se discute es el sistema neoliberal, que contribuye y muchas veces promueve la corrupción, y que al utilizar el sistema penal, lejos de erradicar la corrupción, crea condiciones más favorables para el logro de las políticas neoliberales. Para discutir este tema, en primer lugar, se expone brevemente el problema del concepto de corrupción. Posteriormente, habla del neoliberalismo, relacionándolo con la corrupción y el sistema penal. La última parte del trabajo aborda la criminalización de la corrupción y sus efectos sociales. Finalmente, en las consideraciones finales, retomamos brevemente lo discutido y buscamos demostrar la correlación entre el neoliberalismo, la corrupción y el sistema penal, y la forma en que sustentan la existencia de uno y otro. Se utilizó el procedimiento de revisión bibliográfica para situar, investigar e interpretar el problema, tomando como referencia los trabajos de académicos, sociólogos y criminólogos que abordan críticamente el tema abordado.O presente artigo visa refletir acerca da relação de retroalimentação existente entre o neoliberalismo, a corrupção e o sistema penal. A corrupção hodiernamente é divulgada como o pior mal do país, responsável pelas mazelas sociais que a população vivencia, e que, por esse motivo, deve ser combatida de forma intransigente. Para esse combate, aciona-se o sistema penal, que teria a suposta função de suprimi-la. Todavia, o que não se discute é o sistema neoliberal, que contribui e muitas vezes promove a corrupção, e que, ao se utilizar do sistema penal, longe de erradicar a corrupção, cria condições mais favoráveis para a consecução das políticas neoliberais. Para discorrer sobre essa questão, em primeiro lugar expõe-se sucintamente a problemática acerca do conceito de corrupção. Posteriormente, disserta-se acerca do neoliberalismo, relacionando-o com a corrupção e com o sistema penal. A última parte do trabalho discute a criminalização da corrupção e seus efeitos sociais. Por fim, nas considerações finais, retoma-se sucintamente o que foi abordado e busca-se demonstrar a correlação entre o neoliberalismo, a corrupção e o sistema penal, e a forma como eles dão suporte à existência de um e de outro.
