The First Brazilian Republic and the Supreme Federal Court: learning from the past so as not to err in the present and improving in the future

Resumo: The proactive performance of the Supreme Federal Court has raised criticism and fears over the past few years. It is feared a disharmony between the Powers. However, the answer to this fear would not be an excessive limitation in their performance. For this reason, the present work will analyze the constitutional role of the Judiciary Power in the inauguration of the Brazilian Republic, more specifically its top organ, the Supreme Federal Court. After that, it will briefly and succinctly compare the actions of the Supreme Court in both the First and Sixth Republics of Brazil. Through doctrinal, jurisprudential and normative sources, we will seek to emphasize the importance of the Supreme Federal Court of Brazil in guaranteeing Brazilian constitutional rights, as well as the need to maintain harmony between the Powers.

Se teme la desarmonía entre los poderes. Sin embargo, la respuesta a este temor no sería una limitación excesiva en su desempeño. Por esta razón, en el presente trabajo se analizará el papel constitucional del Poder Judicial en la inauguración de la República de Brasil, más específicamente su órgano principal, el Supremo Tribunal Federal. Después de eso, comparará breve y sucintamente las acciones del Supremo Tribunal Federal tanto en la Primera como en la Sexta República de Brasil. Por medio de fuentes doctrinales, jurisprudenciales y normativas, se buscará enfatizar la importancia del Supremo Tribunal Federal de Brasil en la garantía de los derechos constitucionales brasileños, así como la necesidad de mantener la armonía entre los Poderes.  A atuação proativa do Supremo Tribunal Federal tem levantado críticas e temores ao longo dos últimos anos. Teme-se uma desarmonia entre os Poderes. No entanto, a resposta para esse temor não seria uma limitação excessiva na sua atuação. Por esta razão, o presente trabalho analisará o papel constitucional do Poder Judiciário na inauguração da República Brasileira, mais especificamente seu órgão de cúpula, o Supremo Tribunal Federal. Após isso, comparará, de maneira breve e sucinta, a atuação do Supremo Tribunal Federal tanto na Primeira, quanto na Sexta República.
