ESTRATÉGIA POLÍTICA E JUDICIALIZAÇÃO

A proeminente atuação das cortes judiciais na intervenção em aspectos centrais do funcionamento da democracia é uma constatação recorrente da literatura sobre judicialização da política (TATE e VALINDER, 1995; VIANNA, 1996 e 2002; ARANTES, 2002).  Este artigo teve por objetivo compreender os possíveis desdobramentos teóricos da incorporação da atuação do Judiciário como variável analítica importante para o entendimento da política, seja como tática da oposição, como instrumento de governo ou como arbitragem de interesses em conflito (TAYLOR e DA ROS, 2008). Partindo de uma concepção institucional do fenômeno da judicialização, pretendeu-se abordar as potencialidades teóricas da incorporação do Judiciário como ator político não neglicenciável no jogo político, em particular para os modelos teóricos de estudos legislativos. Controle de Constitucionalidade. POLITICAL STRATEGY AND JUDICIALIZATIONABSTRACT: The prominent role of the courts intervention in central aspects of the functioning of democracy is made repeatedly in the literature on judicialization of politics (TATE and VALINDER, 1995; VIANNA, 1996 and 2002; ARANTES, 2002). This article aims to analyze possible consequences of incorporation of the theoretical performance of the judiciary as an important variable to the understanding of politics, whether as a tactic of the opposition, as an instrument of government or as arbitration of conflicting interests (TAYLOR and DA ROS, 2008). From an institutional design of the phenomenon of legalization, we sought to address the theoretical potential of incorporation of the judiciary as a non-negligible political actor in the political game, especially for theoretical models of legislative studies.
