Resumo: Although it is a human and fundamental right, freedom of expression can result in harmful speech, such as hate speech and misinformation. This study examines the limits imposed on the right to freedom of expression, aiming to guarantee its fullness in a democracy. In the meantime, this research aims to identify the criteria that enable the maximization of freedom of expression, while minimizing its limitations, based on the hypothesis that the principle of proportionality is an essential tool for resolving conflicts involving the right to freedom of expression. Thus, the theoretical foundations and legal aspects related to this right are explored, examining its limits and the role of the Inter-American Court of Human Rights in cases involving it, as well as the legal tools available in the Brazilian legal system to deal with the speech of hate and fake news, also addressing the concept of these phenomena. The method used is hypothetical-deductive, with a bibliographic and documentary approach, in addition to case analysis. Therefore, an international perspective is proposed, centered on Brazil and the Americas, in order to investigate the criteria that guide the expansion of freedom of expression and the reduction of its limitations.

Este estudo examina os limites impostos ao direito à liberdade de expressão, visando a garantia de sua plenitude em uma democracia. Nesse ínterim, esta pesquisa pretende identificar os critérios que possibilitam a maximização da liberdade de expressão, ao mesmo tempo em que minimizam suas limitações, partindo da hipótese de que o princípio da proporcionalidade é ferramenta essencial à solução dos conflitos que envolvem o direito à liberdade de expressão. Assim, exploram-se os fundamentos teóricos e aspectos legais relacionados a este direito, examinando seus limites e a atuação da Corte Interamericana de Direitos Humanos em casos que o envolvem, bem como as ferramentas jurídicas disponíveis no ordenamento jurídico brasileiro para lidar com o discurso de ódio e as fake news, abordando também o conceito destes fenômenos. O método utilizado é o hipotético-dedutivo, com abordagem bibliográfica e documental, além da análise de casos.
