Resumo: This study, through bibliographical and precedent research, analyzes licensing and environmental compensation, as well as attributes the relationship between the procedures and their importance in sustainable development for an ecologically balanced environment. The advent of new technologies culminated in the unrestrained exploitation of natural resources, environmental legislation has been developed to control these impacts to prevent irreversible damage to the environment. During the work, the concept and implementation of licensing and compensation procedures are presented, as well as potentially polluting activities, damages and measures to contain them. The text also makes a critical analysis of the controversial Bill No. 2159/2021, which discusses the relaxation of environmental laws, mainly in matters of licensing, in the same way that it concludes on the advances in environmental legislation on the national scene and the omission of the Public Power in its prerogative to preserve the environment.

O advento de novas tecnologias culminado com a exploração desenfreada dos recursos naturais, fez com que a legislação ambiental se desenvolvesse para o controle desses impactos para impedir a ocorrência de danos irreversíveis ao meio ambiente. No decorrer do trabalho, é apresentado o conceito e a instauração dos procedimentos de licenciamento e compensação, bem como as atividades potencialmente poluidoras, danos e medidas para sua contenção.
