Resumo: This thesis contextualizes the concern with the human rights of children and teenagers, no-tably regard to teenagers in conflict with the law. The attention that must be given to them is global, even more today, when globalization is increasingly intense, so that the countries must strengthen international cooperation in this aspect, through treaties and conventions, supporting Constitutions and other laws, in a true dynamogenic process that encourages the constant and gradual evolution of the protective treatment that children and teenagers must receive systematically. Specifically in the context of teenagers responsible for infractions, emerges the task of seeking alternatives to punitive logic, which has long been shown to be insufficient to address the full complexity of the phenomenon of transgression of the posi-tive norm. In this context, Restorative Justice presents itself as an opposition of epistemo-logical and methodological origin, aiming not at punishing the teenager offender, but at finding solutions to heal wounds, traumas and losses caused by the infraction. Therefore, through bibliographical review and theoretical-critical confrontation, aiming to identify pos-sible theoretical contributions to Restorative Justice, we sought to go through the law chang-es that transformed the way of understanding and applying the rights of children and teenag-ers, according to the new paradigm established by the Brazilian Child and Teenager`s Stat-ute. The descriptive and exploratory method was adopted in terms of objective, qualitative in terms of approach and bibliographic in terms of procedure, whose theoretical basis comes from specialized literature on the subject and international and Brazilian legal doctrine. It was possible to verify that in Brazil, the 1979 Minors Code was revoked, which adopted the doctrine of irregular situation, where children and teenagers were treated as objects of rights. However, given the force of the Child and Adolescent Statute of 1990, supported by the Federal Constitution of 1988, both reflected in international treaties and conventions to which Brazil is a signatory, the panorama has changed to provide children and teenagers treatment as subjects of rights, through acceptance of the doctrine of full protection. Among the new legal dispositions, are the institutes of Restorative Justice and Mediation, which present themselves as an alternative to the convicting culture. So, these concepts were ana-lyzed, especially in accordance to the theoretical framework proposed by Luis Alberto Wa-rat for ecological mediation, according to the perspective of fraternal law, by Eligio Resta. By the end, we sought to identify the contributions of the institutes in the context of holding teenagers responsible for infractions. Thus, new perspectives were taken on the concepts that underlies Restorative Justice and Mediation, applied in the context of Children and Youth, favoring actions that truly promote the self-composition of conflicts and the much-desired social pacification, always in search of interpretations and broader applications, in accord-ance with the desire for social change.

É mundial a atenção que lhes deve ser destinada, ainda mais na atualidade em que a globalização se apresenta cada vez mais intensa, de maneira que os Estados devem estreitar a cooperação internacional nesse aspecto, por meio de tratados e convenções, sustentáculos de Constituições e leis infraconstitucionais, num verdadeiro processo dinamogênico que fomenta a constante e paulatina evolução do tratamento protetivo que as crianças e adolescentes devem receber sistematicamente. Especificamente no âmbito da responsabilização de adolescentes por atos infracionais, emerge a tarefa de buscar alternativas à lógica punitiva, que há muito já se mostrou insuficiente para abordar toda a complexidade do fenômeno da transgressão da norma positivada. Nesse contexto, a Justiça Restaurativa se apresenta como uma oposição de origem epistemológica e metodológica, visando não a punição do adolescente infrator, mas a busca de soluções para a cura de feridas, traumas e perdas causadas pelo ato infracional. Assim, por meio da revisão bibliográfica e do enfretamento teórico-crítico, com o objetivo de extrair possíveis contribuições teóricas para a Justiça Restaurativa, no âmbito da Infância e Juventude, buscou-se perpassar pelas mudanças legislativas que transformaram o modo de se compreender e aplicar os direitos das crianças e dos adolescentes, conforme o novo paradigma estabelecido pelo Estatuto da Criança e do Adolescente. Adotou-se o método descritivo e exploratório quanto ao objetivo, qualitativo quanto à abordagem e bibliográfico quanto ao procedimento, cuja base teórica advém da literatura especializada sobre o tema e a doutrina jurídica internacional e brasileira. Foi possível verificar que no Brasil houve a revogação do Código de Menores de 1979, que acolhia a doutrina da situação irregular, em que crianças e adolescentes eram tratados como objetos de direitos. Porém, diante da entrada em vigência do Estatuto da Criança e do Adolescente de 1990, apoiado na Constituição Federal de 1988, ambos espelhados em tratados e convenções internacionais que o Brasil é signatário, guinando-se o panorama até então em vigor para proporcionar às crianças e adolescentes o tratamento como sujeitos de direitos, por meio do acolhimento da doutrina da proteção integral. Dentre as novas previsões legais, existem os institutos da Justiça Restaurativa e da Mediação, que se apresentam como uma alternativa à cultura da sentença. Assim, tais conceitos foram analisados, especialmente de acordo com o marco teórico proposto por Luis Alberto Warat para a mediação ecológica, de acordo com a perspectiva do direito fraterno, de Eligio Resta. Buscou-se, ao final, identificar as contribuições dos referidos institutos no âmbito da responsabilização de adolescentes por atos infracionais. Assim, foram lançados novos olhares sobre os conceitos que fundamentam a Justiça Restaurativa e a Mediação, aplicadas no contexto da Infância e Juventude, favorecendo-se medidas que realmente promovam a autocomposição dos conflitos e a pacificação social tão almejada, sempre em busca de interpretações e aplicações mais amplas, de acordo com os anseios por mudanças sociais.Fundação Universidade Federal de Mato Grosso do SulUFMSBrasilAdolescentes.
