Resumo: The institute of the right to be forgotten involves some questions of law that in certain cases cause great divergences, which is why it is necessary to specifically study each case involving abuse. In this sense, the research aims to study the right to be forgotten from a human rights perspective within the information society. In this way, we seek to answer how the institute in question is understood within the Brazilian legal system, focusing on the understanding of the Federal Supreme Court. The justification arises from the recognition of the thematic repercussion, given the great controversies nowadays regarding the subject under study. The method used is deductive, in order to analyze bibliographical, documentary and jurisprudential research.

Nesse sentido, a pesquisa tem por objetivo um estudo sobre o direito ao esquecimento sob uma perspectiva dos direitos humanos dentro da sociedade da informação. Desse modo, busca-se responder como o instituto em apreço é entendido dentro do ordenamento jurídico brasileiro, com enfoque no entendimento do Supremo Tribunal Federal. A justificativa decorre do reconhecimento da repercussão temática, haja vista grandes controvérsias hodiernamente acerca do assunto em estudo.
