This study investigates the functioning of civil liability in cases of work accidents in the context of outsourcing. Its main objective is to identify the operationalization of civil liability in these situations, examining the relevant legislation in the Brazilian legal system. Furthermore, it seeks to analyze concepts found in the literature related to the commitment and responsibility of service-taking companies, considering the historical-social context and the nature of this relationship. The theoretical research methodology uses information from existing literature on the issue of civil liability in cases of work accidents involving outsourced employees. The analysis focuses on Brazilian standards that regulate the employment relationship in outsourcing and the subjects involved in this relationship. In this study, reparation, both moral and material, in the civil sphere can be carried out in favor of the outsourced employee in relation to service-taking companies and service-providing companies, with regard to the work accident.
