Resumo: The present work aims to investigate, from the bibliographical review and analysis of case law of reference, the importance of debating the chain of custody of digital evidence, highlighting its origin, concept and characteristic, as well as the importance of applying a standard that regulates the chain of custody of digital evidence. Realizes that the Superior Courts are still reluctant to study about the "chain of custody of digital evidence", although they have already ruled that deliberation on digital evidence, although this judgment does not analyze the detailed form that was obtained, limiting itself to position in legality or illegality due to judicial permission. However, with an ever greater and faster evolution of technology, the law in its entire sphere (Civil, Criminal) seeks this movement, specifically how to use this digital medium as evidence in the process.

Percebese que os tribunais Superiores ainda estão relutantes em posicionar a respeito da “cadeia de custódia da prova digital”, embora já tenham julgados que estabelece sobre a prova digital, entretanto estes precedentes não analisa a forma detalhada que foi obtida, se limitando a posicionar em legalidade ou ilegalidade devido autorização judicial.
