Resumo: The volume of legal devices constructed by legislators, daily, increase exponentially, and still have to be considered the more than significant portion of these, received by the Constitutional Text. From this format we come across certain situations, where it was common to question whether "a certain legal device has or has not."Among other reasons for this occurrence, the large number of devices inserted in the unencrypted legal framework, called "sparse laws" stands out, a situation that is a true entanglement which requires constant and constant care by the operators of the law. The purpose of this paper is to deal specifically with the "Value of Judicial Expertise of Engineeri ng Performed by Laymen", providing a discussion of the validity or not of the work thus carried out and included in the procedural document, resulting from the judicially determined mister.

A partir desse formato deparamos com determinadas situações, onde ficou comum questionar se “determinado dispositivo legal pegou ou não”. Dentre outras razões para tal ocorrência, destaca se o grande volume dispositivos inseridos no arcabouço legal não codificado e denominadas “Leis esparsas”, situação que constitui verdadeiro emaranhado o qual exige permanente e constante cuidados dos operadores do direito.
