Resumo: The main object of this work, is to talk about the importance of mediation as on altenative to solve conflicts, their characteristics and functions against the Brazi-lian Legal Order. For that, was used doctrinal research, as searches to other articles and published texts on the internet. The present work has the cord to relate the beginning of mediation throw the resoluction of the National Council of Justice n 125 and the creation of the law 13.140/2015 as the new approached in the new cod of Civil Process (Lei 13.105/2015). Therefore, approach the function of social needs in the implatation of a cul-ture turnned to a social pacification and sheowing that the method doesn`t have the object of pushing aeway the jurisdictional activits or discredit, but to work together to creat in Brasil a mediational culture.

Para tanto, foi utilizado pes-quisa doutrinária, bem como pesquisas a outros artigos científicos e textos publica-dos em sites da Internet.
