The present work refers to the quantification of moral damage, where human and legal history has evolved human actions and interactions, between obligations and duties. It has the history of civil responsibility from historical landmark dating from the end of the third century, A.C, where the LEX AQUILIANA OF DAMNO, the laws of the 12 tablets. We also sought the pedagogical approach of objective and subjective civil liability, since without the characterization of this we can not speak of moral damage. The fact is that, as added to the work, there is a discrepancy between the delinquent conduct and the satisfaction in the compensation of the damage, with the quantification of the moral damage carried out subjectively by the legislator, since the decisions gathered here. the legislator's need to recklessly attempt to quantify moral damages, the debate was also sought on the standardization of jurisprudence regarding the Special Civil Courts of Cuiabá and Várzea Grande, together with the decisions of the Appeals Courts.
