PROÁGUA, Pró-Reitoria de Pesquisa e Pós Graduação, Universidade Federal de Ouro Preto.Indaga-se na pesquisa sobre o enquadramento das limitações socioambientais do direito de propriedade ao que Michel Foucault, na tese da biopolítica, caracteriza como dispositivos de governamentalidade. Como dispositivos derivados do processo de racionalização do governo da vida da população em prol do corpo são, do indivíduo enquanto empresa; e ao mesmo tempo como instrumento de controle do capitalismo. Sobre essa questão procurou-se identificar, no estado da arte, a existência de estudos sobre a aplicação da teoria da biopolítica e da governamentalidade ao movimento político-ambiental experimentado nos últimos 50 anos, quando foram identificados estudos e autores precursores – Rutherford (2000) e Darier (1999) – da tese da aplicação das teorias de Michel Foucault ao movimento da sustentabilidade. Intitulada ecopolítica e ecogovernamentalidade, essas teorias informam a aplicação da tese da biopolítica ao processo de racionalização do governo da vida da população pelo governo do meio em que vive, pelo que todo tipo de intervenção em matéria de utilização dos recursos ambientais seria enquadrado como dispositivo de ecogovernamentalidade. Fundado no método jurídico-teórico de pesquisa em direito, o esforço de pesquisa, depois de desenvolver os pressupostos jusfilosóficos do direito de propriedade e do seu processo de funcionalização socioambiental, iniciou apontamentos sobre as teorias da biopolítica e da governamentalidade. Pressupostos necessários à compreensão das teorias da ecopolítica e à construção da hipótese da pesquisa. Dessas ações, pôde-se concluir que as limitações socioambientais ao direito de propriedade, por serem uma das bases do processo político-econômico de controle do uso dos recursos da natureza, informado pela verdade da necessidade de proteção da vida da humanidade, são dispositivos de governamentalidade, ou, de ecogovernamentalidade como informam os adeptos da teoria da ecopolítica.Asks in research on the framework of social and environmental limitations of property rights to what Michel Foucault, in the thesis of biopolitics, characterized as governmentality devices. As devices derived from the government's rationalization process of people's lives govern a a function of the body, are the individual as a company; and at the same time as capitalism control tool. On this issue it was tried to identify, in the state of the art, the existence of studies on the application of the theory of biopolitics and governmentality to the political-environmental movement experienced in the last 50 years when studies and authors precursors were identified - Rutherford (2000) and Darier (1999) – of the thesis of theories application of Michel Foucault to the sustainability movement. Entitled ecopolitics and eco-governmentality, these theories inform the application of the theory of biopolitics to the rationalization process of the population's life government by the govern of middle that you live in, so that every type of intervention on the use of environmental resources would be framed as device eco-governmentality. Founded in legal-theoretical method of research in law, the research effort, after developing the legal-philosophical assumptions of property rights and its social and environmental functionalization process, started notes on the theories of biopolitics and governmentality. Assumptions necessary for understanding the theories of ecopolitics and to the construction of the hypothesis of the research.
