O Ensino Médio é uma das etapas da Educação Básica, estabelecida e regulamentada constitucionalmente no Brasil, sendo uma responsabilidade compartilhada entre o Estado e a família com a colaboração da sociedade. In this way, it aims to develop the human being as a citizen in the process of qualifying for social life and, at the same time, to qualify for the exercise of a profession. In this sense, in a state public high school in the east zone of the city of Manaus, State of Amazonas, students have all the administrative and pedagogical apparatus to receive quality education and teaching. However, pedagogical objectives are often not achieved, considering that few third-year students are able to enter higher education at a public university. The research is justified by its relevance for the city of Manaus and for the academic world, as the legal pedagogical context will outline the implementation of the educational process, becoming effective in the classroom. Thus, the starting point is the following question: how can pedagogical mediation provide a process for students to access higher education, with a view to realizing the right to continued education? The study's general objective is to analyze the perspectives of pedagogical mediation in the process of access for students completing secondary education to higher education, as an institute of educational law capable of favoring the realization of the right to education. And as specific objectives: characterize the legal foundations of educational rights, education, citizenship, secondary education in Brazil and delimit the branch of educational law and its relationship with the right to education; know the foundations of fundamental rights and citizenship as the basis of the teacher-student relationship from the perspective of the teaching/learning process with a focus on the institute of pedagogical mediation; identify the legal foundations of the right to education and culture of peace in the pedagogical relationship between students and teachers in the classroom teaching process; understand the perspectives of school pedagogical mediation and educational rights and education in a high school in access to higher education in Manaus. Based on academic performance at a state high school in the city of Manaus; and propose education as a promoter of social change citizenship in Manaus and a comprehensive set of guidelines aimed at significantly improving the educational environment at school. The guidelines not only strengthen the academic foundation, but also promote an engaged and participatory educational community. Bibliographical research was adopted, with a qualitative-descriptive approach based on the academic indexers Capes, Scholar, (Google academic), BDTD, Vlex of the virtual library system of the University of Fortaleza (UNIFOR). Research instruments are the Boolean Operators AND, and OR. For documentary research, some documents stand out, such as: Universal Declaration of Human Rights of 1948; the 1988 Federal Constitution; Education Guidelines and Bases Law (LDB) or Law No. 9,394/1996; the National Curricular Guidelines for Secondary Education; the New National Curriculum Guidelines for Secondary Education; Pedagogical Political Project for the school of the year 2023; the National Curricular Parameters for Secondary Education. Field research, submitted to the Ethics Committee, under the CAAE protocol: 60243422.0.0000.5052, opinion: 5,534,423 on 07/19/2022. Carried out at the Dr. Isaac Sverner State School in Manaus, based on interviews and the application of questionnaires with closed questions to a sample of 180 (one hundred and eighty) students and 30 (thirty) teachers and managers from the morning, afternoon and night shifts of the school. school researched. Using quantitative and qualitative approaches, under a dialectical bias, it is concluded that pedagogical mediation needs to be understood and socialized among educators; access to higher education becomes an achievement for students who build learning since elementary school with prospects for the future with education and also, the right to education, as a constitutional precept, is not effective without the availability, work and ethics of humanity of individuals who are responsible for educating, whether informally or formally. Desse modo, visa ao desenvolvimento do ser humano enquanto cidadão em processo de habilitação para o convívio social e, paralelamente, para a qualificação ao exercício de uma profissão. Nesse sentido, em uma escola pública estadual de ensino médio na zona leste na cidade de Manaus, Estado do Amazonas, os alunos têm todo o aparato administrativo e pedagógico para receber uma educação e um ensino com qualidade. Porém, muitas vezes, os objetivos pedagógicos não são atingidos, tendo em vista que são poucos os alunos do terceiro ano que conseguem ingressar no ensino superior em universidade pública. A pesquisa se justifica pela sua relevância para a cidade de Manaus e para o mundo acadêmico, na medida em que o contexto pedagógico jurídico vai delinear a efetivação do processo educativo, tornando-se eficaz em sala de aula. Assim, parte-se do seguinte questionamento: como a mediação pedagógica pode propiciar um processo de acesso dos estudantes ao ensino superior, com vistas à efetivação do direito à educação continuada? O estudo tem como objetivo geral analisar as perspectivas da mediação pedagógica no processo de acesso de estudantes concluintes do Ensino Médio ao Ensino Superior, enquanto instituto do direito educacional capaz de favorecer a efetivação do direito à educação. E como objetivos específicos: caracterizar os fundamentos legais dos direitos educacional, educação, cidadania, ensino médio no Brasil e delimitar o ramo do direito educacional e a sua relação com o direito à educação; conhecer os fundamentos do direito fundamental e cidadania como base da relação professor-aluno sob a perspectiva do processo ensino/aprendizagem com foco no instituto da mediação pedagógica; identificar os fundamentos legais do direito à educação e cultura de paz na relação pedagógica entre discente e docente no processo de ensino em sala de aula; compreender as perspectivas da mediação pedagógica escolar e dos direitos educacional e educação em uma escola de ensino médio no acesso ao ensino superior em Manaus. A partir do rendimento escolar em uma escola estadual de ensino médio na cidade de Manaus; e propor a educação como promotora de mudanças sociais cidadania em Manaus e um conjunto abrangente de diretrizes visando aprimorar significativamente o ambiente educacional na escola. As diretrizes não apenas fortalecem o alicerce acadêmico, mas também promovem uma comunidade educativa engajada e participativa. Adota-se a pesquisa bibliográfica, com abordagem qualitativa-descritiva com base nos indexadores acadêmicos Capes, Scholar, (Google acadêmico), BDTD, Vlex do sistema de biblioteca virtual da Universidade de Fortaleza (UNIFOR). Instrumentos de pesquisa os Operadores Booleanos AND, e OR. Para a pesquisa documental ressaltam–se alguns documentos, tais como: Declaração Universal dos Direitos Humanos de 1948; a Constituição Federal de 1988; Lei de Diretrizes e Bases da Educação (LDB) ou Lei nº 9.394/1996; as Diretrizes Curriculares Nacionais para o Ensino Médio; as Novas Diretrizes Curriculares Nacionais para o Ensino Médio; Projeto Político Pedagógico da escola do ano 2023; os Parâmetros Curriculares Nacionais para o Ensino Médio. Pesquisa de campo, submetida ao crivo de Comitê de Ética, sob o protocolo CAAE: 60243422.0.0000.5052, parecer: 5.534.423 em 19/07/2022. Realizada na escola Estadual Dr. Isaac Sverner de Manaus, a partir de entrevistas e aplicação de questionários com perguntas fechadas em amostra de 180 (cento e oitenta) estudantes e 30 (trinta) professores e gestores dos turnos de funcionamento matutino, vespertino e noturno da escola pesquisada. Mediante abordagens quantitativa e qualitativa, sob o viés dialético, conclui-se que a mediação pedagógica precisa ser compreendida e socializada entre os educadores; o acesso ao ensino superior se torna uma conquista para os estudantes que constroem aprendizagens desde o Ensino Fundamental com perspectivas de futuro com educação e ainda, o direito à educação, como preceito constitucional, não se efetiva sem à disposição, o trabalho e a ética de humanidade de indivíduos que têm a incumbência de educar, seja informal, seja formalmente.
